EJEMPLO 1

Pediste un primer crédito de 300€ y pagas 500€, pides un segundo crédito de 500€ y pagas 750€ y por último pides un crédito de 600€ y pagas 900€, al final terminas pagando 2150€ con intereses, cuando la cantidad total solicitada fue de 1400€. Si reclamas con nosotros te ayudaríamos a que te devolvieran 750€ que pagaste de más en intereses.

EJEMPLO 2

Pediste un primer crédito de 300€ y pagas 500€, pides un segundo crédito de 500€ y pagas 750€ y por último pides un crédito de 600€ y pagas 900€, al final terminas pagando 2150€ con intereses, pero luego pides otro crédito de 600€, el cual no has terminado de pagar,  y por este crédito te están pidiendo 900€, reclamando con nosotros conseguiríamos que te devuelvan los intereses pagados anteriormente (750€) además conseguimos que el último crédito lo devuelvas a interés 0% (600€ y no los 900€ que te pedían). En este caso te recuperamos 750€ y te ahorramos de pagar 300€.

Has obtenido un préstamos de forma rápida y sin demasiados requisitos, puede ser que tengas un microcrédito con intereses abusivos.

¿Qué son los microcréditos?

Son créditos sin garantía real, normalmente de pequeñas cantidades sin exigir demasiados requisitos para ello. La gran mayoría de estos microcréditos ofrecidos por algunas de las entidades que más adelante se señalarán, contienen una gran cantidad de intereses abusivos.

¿Qué son los intereses abusivos?

Es cuando el interés fijado en el préstamo es superior y desproporcionado. El 4 de marzo El Tribunal Supremo dictamina que a partir del 20% TAE puede existir usura.

 

¿Puedo reclamar un microcrédito con un interés superior al 20%?

Por supuesto, el Supremo considera usura los contratos de microcréditos con intereses superiores al 20%.  El artículo 1 de la Ley de 23 de julio de 1908 sobre nulidad de los contratos de préstamos usurarios, determina como nulo cualquier contrato de préstamo, extensible a un crédito, en que se estipule un interés notablemente superior al normal del dinero y desproporcionado.
